Who May File a Complaint?

FRTIB employees, former employees, and applicants for employment are protected under various laws from discrimination in hiring, promotion, removal, benefits, job training, classification, referral, and other aspects of employment, and have a right to file an EEO complaint if they believe they have been discriminated against on the basis of: RACE, COLOR, RELIGION, SEX (INCLUDING PREGNANCY, AND SEXUAL ORIENTATION), NATIONAL ORIGIN, AGE, DISABILITY, GENETIC INFORMATION AND REPRISAL.

Religious and disability discrimination includes failure to reasonably accommodate an employee where the accommodation does not impose undue hardship. Additionally, reprisal entails retaliation against a person who files a charge of discrimination, participates in a discrimination proceeding, or otherwise opposes an unlawful employment practice.

When to File a Complaint

You must file a complaint within 45 calendar days of the date of the matter alleged to be discriminatory or, in the case of a personnel action, within 45 days of the effective date of the action.

Matters Covered by the EEO Complaint Process

The FRTIB EEO Office processes complaints of discrimination in accordance with 29 CFR §1614. This federal process applies to discrimination allegations based on protected classes under laws such as the Title VII of the Civil Rights Act when the matter involves:

  • Employment with FRTIB; or
  • Actions taken by FRTIB that affects employees or applicants for employment

Matters Outside of the EEO Complaint Process

Since the federal sector EEO process is limited to FRTIB employment-related matters, the following types of concerns generally fall outside the scope of the process:

  • Actions taken by other federal agencies;
  • Administration of federal benefits programs (such as retirement accounts) by agencies like FRTIB; or
  • Issues not involving a personnel action or employment relationship with FRTIB In these cases, the EEO Office may not have authority to accept a formal EEO complaint. Some matters involving federal benefits programs may be governed by separate statutory and legal frameworks outside of the EEO complaint process.
